This policy describes how Technologies Remedia Inc. and its affiliates (“Remediaorwe”) collect, use, share, store, and otherwise process personal information of users of the Remedia educational content management software solution (the “Solution”).

Remedia may collect and process personal information outside of the Solution, including through its website. This policy does not cover those activities.

1. Context and Interpretation

In this privacy policy:

  • Establishment”: the educational institution that has contracted with Remedia to use the Solution;
  • Usage Data” means data related to the use of the Solution by Users, which may contain personal information when identifying individual users is necessary.
  • Personal Information” means information about an identifiable individual or any information designated as such by applicable privacy legislation;

Remedia processes personal information about several categories of users:

  • Students” means pupils enrolled in an Establishment using the Application;
  • Parents” means the parents or guardians of Students under 14 years old;
  • Teachers” means teachers at an Establishment using the Application;
  • Administrators” means users of the Application with administrative privileges who represent the Establishment;
  • User” means any end user of the Solution, including Students, Teachers, Parents, and Administrators;

The use of the second person (“you” or “your”) refers to a User.

Except for Administrators, Remedia processes personal information about Users on behalf of an Establishment and not for its own purposes.

Remedia has adopted written policies regarding the processing of personal information throughout its lifecycle. Remedia employees are subject to a code of conduct and clear policies regarding the security of confidential information, including personal information.

3. What personal information do we collect?

3.1. Students

We collect personal information about Students only on behalf of Establishments, as their service provider.

The following information is collected about Students:

  • Name or nickname;
  • Email address;
  • Class the Student is associated with;
  • Responses to assessments, activities, and exercises administered through the Solution;
  • Student’s assessment results;

3.2. Parents

At the request of the Establishment, we may collect the name and email address of Parents to document their consent for the Student under their guardianship to use the Solution.

3.3. Teachers

At the request of the Establishment, we may collect the name and email address of Parents to document their consent for the Student under their guardianship to use the Solution.

The following information is collected about Teachers and associated with them:

  • Full name;
  • Professional email address;
  • Classes under the Teacher’s responsibility;
  • Content created by the Teacher;
  • Any communication by the Teacher associated with their account on the Solution;

3.4. Administrators

We collect the following personal information about Administrators or Establishments that are individuals:

  • Full name;
  • Email address;
  • The content of communications sent to us by Administrators, which may contain personal data;

3.5. Analytics Data

The Solution automatically collects certain information about Users for analytical, logging, and security purposes, including:

  • The operating system and device language
  • The IP address from which a device accesses the service
  • The country, state, city, and postal code where the device is located
  • Navigation data, such as pages viewed, number of logins to the service, session duration, and login dates to the Solution.

4. Why do we process personal information?

We process personal information collected through the use of the Solution for the following purposes:

4.1. Operation of the Solution

We process personal information to provide our services to our Establishments, including technical support provided to Users, if applicable.

4.2. User Identification

We process personal information to identify and authenticate Teachers, Parents, and Administrators. We do not identify minor Students; responsibility for identifying Students lies with the relevant Establishment.

4.3. Administration and Billing

We may use personal information about Administrators to manage the contractual relationship with an Establishment and to issue invoices.

4.4. Product and Service Improvement

We may use Usage Data in an aggregated and anonymous manner to analyze the use of the Solution and improve our products.

4.5. Maintenance and Security

We process data automatically collected through the Solution, as well as data from analytics tools, to prevent misuse of the Solution and to identify issues or bugs in the Solution.

4.6. Legal Compliance

When applicable, we process personal information to comply with laws and regulations that apply to our activities, including defending ourselves in legal proceedings and responding to court orders.

5. Retention of Personal Information

Retention of personal information by Remedia is subject to policies consistent with industry standards in information security, including information classification, access control, risk management, and management of information assets.

We retain your personal information only as long as necessary for the processing purposes described or, where applicable, until you or the relevant Establishment ask us to delete it. Retention duration is determined by the reasons for collecting and using the information and/or by applicable laws. The destruction of personal information is carried out in compliance with our information security policies.

Remedia is a company based in the province of Quebec, Canada, but some limited data may be processed by service providers based in other jurisdictions through facilities located outside Canada, including in the United States. We ensure that the transfer of such personal information is done with appropriate safeguards. Educational information, such as assessment results, is never processed outside of Canada.

6. How we protect personal information

Remedia has implemented organizational, physical, and technical measures to secure personal information entrusted to it. You may request a more detailed description of the security measures in place to protect personal information by writing to us at [email].

Personal information is hosted on servers operated by our service providers and is protected against unauthorized access or use by security measures proportionate to the sensitivity of the data. Financial data, where applicable, is subject to additional security measures consistent with standards established by payment card networks.

Our employees and providers are informed of the confidential nature of the personal information collected through the Solution. They are made aware of appropriate security measures to prevent unauthorized access to personal information.

7. Who has access to personal information?

Your personal information may be disclosed to the categories of recipients below for the purposes described:

7.1. Remedia Employees

Personal information is accessible to our officers and employees who require access as part of their duties. Each employee is bound by a confidentiality agreement.

7.2. Establishments

The relevant Establishment may access all personal information collected through the Solution. Where personal information about a User (except an Administrator) is collected, it is collected by the Establishment through the Solution.

7.3. Service Providers

Some of our service providers have access to personal information collected through the Solution. We only share personal information with service providers who commit in writing to preserving the confidentiality of personal information and who implement security and protection measures comparable to ours.

7.4. Affiliates

We may share your personal information with subsidiaries or affiliates for the purposes described in this policy.

7.5. Other Third Parties

Applicable Law: We may disclose personal information to third parties if expressly permitted or required by law, or if compelled to do so by a competent authority. We may disclose personal information in legal proceedings if necessary to protect our rights or those of our Establishments, or to comply with national security or law enforcement requirements.

Business Transfer: If the sale or restructuring of all or part of our business is considered, we may disclose personal information to relevant parties before and after the transaction, whether or not it is completed. In this case, those parties commit to preserving the confidentiality of personal information disclosed and to using it exclusively to assess the feasibility of the transaction and in accordance with this policy if the transaction is completed.

8. Your Privacy Rights

When we process personal information on behalf of an Establishment (if you are a Student, Parent, or Teacher), you must contact your Establishment directly to exercise your rights regarding your personal information. In such cases, we will forward your requests to the relevant Establishment and cooperate with them regarding your request. We are not authorized by Establishments to communicate information directly to Users.

8.1. Withdrawal of Consent

Your browser and the cookie management tool built into the Solution allow you to withdraw your consent to certain processing of your personal information, such as preventing the recording of cookies.

If you wish to withdraw your consent for the processing of your personal information beyond what is allowed by the Website or your browser, please let us know by writing to [email]. Use of the Solution involves certain processing of your personal information. The only way to stop all processing of your personal information is to stop using the Solution.

8.2. Right of Access, Rectification, and Portability

If you wish to access the personal information we hold about you or have inaccurate personal information in our files corrected, you can make a request at [email]. We will respond promptly and no later than the deadlines required by applicable law. If required by law, we will provide the personal information in a structured, commonly used, and machine-readable format.

8.3. Right to Deletion

8.6. Verification

We may verify the identity of individuals requesting to exercise their rights regarding their personal information. Any information collected for this verification will not be used for other purposes.
